How to Search Montgomery County Court Records?

Montgomery County Circuit Court

Montgomery County Circuit Court is part of the Sixth Judicial Circuit, consisting of Montgomery and Frederick counties. It is a trial court of general jurisdiction and is the only court that conducts jury trials. The Circuit Court is responsible for hearing major civil cases and more serious criminal matters, including juvenile and other family law cases such as divorce, custody, and child support. It is also in charge of deciding appeals from the District Court, orphans’ courts, and certain administrative agencies. There are 24 judges appointed by the Governor in Montgomery County Circuit Court.

The Clerk of Montgomery County Circuit Court

The Clerk of the Circuit Court is an elected state official whose duties and responsibilities are created by the laws of Maryland and the Rules of the Court of Appeals of Maryland. KAREN A. BUSHELL is the Clerk of Montgomery County Circuit Court. The Office of Montgomery County Circuit Court comprises 190 state-employed staff working in eight departments of the Court. The functions of Montgomery County Circuit Court are multifaceted, including recording, filing, and maintaining civil, criminal, and juvenile actions, administering the Oath of elected officials, judges, county police officers, etc., issuing marriage and business licenses, and performing marriage ceremonies.

Montgomery County District Court

The District Court came into existence on July 5, 1971, as the Maryland Constitution was amended. It has statewide jurisdiction and is fully state-funded. Jury trials are not conducted by the District Court. The jurisdiction of the District Court includes landlord-tenant disputes, replevin actions, traffic violations, misdemeanors, and some felonies. The District Court is exclusive in civil cases with a maximum of $5,000 and is concurrent with the Circuit Court in claims for between $5,000 and $30,000.
